Kitsap County sled and ATV accident | Tacoma Kitsap County accident attorney

A 10 year old Kitsap County boy suffered serious injuries including facial fractures and other traumas when he was hit by a 53 year old man riding an all terrain vehicle (ATV) early Friday morning at 12:45 am, December 19, 2008. 

The boy was heading north on Banner Road on his sled and the man was traveling south on Banner Road south of SE Fragaria Road in Kitsap County, Washington just before the collision.

The man fled the scene on foot after the crash and was later arrested at his home in Olalla, Washington.  He was charged with vehicular assault and hit and run.

You have to wonder what was the boy doing sledding at night in the dark, and the same could be asked of the man driving the ATV and why did the man leave the scene of the accident.  This case raises serious questions of liability and I'm sure the insurance company, if there is any, for the ATV will try to put the blame on the boy as much as possible to avoid paying medical bills or for bodily injuries.
