We all know the danger of rough seas. A large wave can rock a boat to the point that passengers are tossed about on board or even thrown completely overboard. Most safe boaters know not to go out in rough weather because of the danger of wind and waves, but sometimes the dangerous wave is caused by another boater.

If you were enjoying a nice day on the water and another large or fast boat caused a wake that resulted in you or someone on your boat becoming injured, you may be able to sue for negligence. A judge will take a variety of factors into consideration when determining if the boater was liable, including:

  • Where the wave occurred. A judge will likely look at where the accident took place to determine if the person who caused the wake was at fault. For instance, if the boats were in a no-wake zone, which is commonly found in marinas and harbors, and created any kind of wake that caused the accident, there’s a good chance the person who created the wave would be held liable.
  • The traffic in the area. If a boat was speeding around other boats and causing large waves, the driver may be held negligent. Creating such waves can cause passengers to fall overboard, which is dangerous in certain areas that have a good amount of traffic, as passengers can get run over or injured by the propellers. The waves can also cause boats to crash into other boats.
