Is the left-turn driver always presumed to be at fault in a car accident?



If you were injured in a car accident caused by a driver making a left turn at an intersection, it is likely that he will be presumed to be at fault in causing your collision. This is because a person only has the right of way when making a left turn if he is turning on a green left arrow. In other cases, he must yield to oncoming vehicles going straight through an intersection and pedestrians and bicycle riders in the crosswalk.

When the Driver Making a Left Turn May Not Be at Fault

Even though the presumption may be that the driver making the left turn caused your accident, his insurance company will still try to point the blame at you. However, there are only limited situations where the other driver may not be considered at fault or may be only partially to blame. They include the following:

  • Speeding. If you were driving over the speed limit as you crossed the intersection, you might be considered at least partially to blame. However, this claim is very difficult to prove if there were no witnesses to your accident.
  • Red light. If you ran a red light or drove through a stop sign, you would have been in violation of Washington State traffic laws. In this situation, the driver turning left would most likely not be found responsible for the accident.
  • Unforeseen circumstances. In rare situations, it may have been safe for the person making a left turn to do so when he entered the intersection. However, an unforeseen circumstance, such as a person or animal darting into the road, may have occurred, and he may have been forced to slow down, stop, or swerve out of the way.
