I was rearended , car had less than $500.00 in damages, time to settle - they are say not much damage only $800 for my pain.
I hurt my neck and back as I was slowing down to make a turn when the other car hit me. Now the insurance company says because there wasn't much damage to car I wasn't really hurt. They offered me $750 and to pay my medical for the day of the accident (the first time I called them) but when I said I was hurt they turned hostile so I contacted my insurance company who paid all the bills and said they would collect from the other insurance. I feel my pain and suffering is worth more than the now $800 that they want to offer me but my husband says it wouldn't be worth it to get an attorny as I won't get much of a seetlement and the attorny would take a big part of it. Should I fight it - is it worth it to fight it?
It depends. As you've found out, the insurance companies will argue no damage to your car so no damage to you. The problem is that if you've only had one doctor's visit there is not a whole lot of documentation and it may not be worthwhile getting an attorney.
