Who has right of way in a parking lot? My insurance company claims the person backing up always has right of way.

I was hit by a car backing out of a parking space. The damage is my front quarter and his back quarter. I was partially in the other lane as I was swinging out to park across from this guy. The guy admitted he didn't see me. Why is the insurance company blaming me? I was not speeding. The insurance company said that it was obvious that I wasn't going fast. In addition, there wasn't anything obstructing the view of the guy.
