A man has filed a premises liability lawsuit against a Washington State ski resort regarding a fall injury that took place in 2008. The slip and fall lawsuit states that the man was struck by a ski lift chair and subsequently fell off of the lift platform.

Man Sues Washington Ski Area After Alleged Fall From Chairlift

A man is suing the Mount Baker Ski Area located in Bellingham, Washington, after he suffered a slip and fall accident near the resort’s ski lift.

According to the Bellingham Herald, Paul Witforth has filed a personal injury claim against the ski area in Seattle US District Court. The court files claim that the man, who was visiting from Canada for a ski trip in March 2008, was struck in the back by a ski lift. After he was struck, he fell 20 feet off of the ski lift platform and onto the ground below.

Witford has stated that the lift was shaking from side to side before they boarded and that a ski lift operator did not attempt to stop or stabilize the ski lift seats for the couple. He also said that the safety net meant to protect people from a fall from the ski lift was not big enough to break his fall.

While the papers do not describe the injuries that Witford incurred in his fall, it does seek an unspecified amount of money for his medical needs as well as for his wife Megan’s loss of companionship and support. The couple is being represented by a Seattle personal injury law firm.

According to the ski resort’s manager Duncan Howat, the accident’s details do not add up. How at said that he didn’t remember the accident occurring at all and that in March the snow would be at a high level, making the fall from the ski lift platform much less than 20 feet. In addition, Howart explained that the lift they were using is quite old and slow and that it was unlikely that they would have had a problem with it.
