Seattle Bus Accident Leads to $1.5 Million Wrongful Death Suit

Seattlepi.com reports that King County has settled a wrongful death lawsuit with the family of a man killed in a car and Metro bus collision last year. The case was settled for $1.5 million in damages.

Micael Dahlquist, a 21-year-old Auburn man, was driving on Highway 16 in Seattle in a pickup truck when a metro bus swerved into his path. He died from his injuries. According to NWCN, a passenger in his truck at the time was also killed in the accient.

The bus driver, Sandy Olosky, who was fired in response to the bus crash, had a history of traffic accidents and citations. In court, the Dahlquist's wrongful death lawyer argued that this bad driving record should have prevented her from being on the road behind the wheel of a city bus, and that King County's transit agency was negligent in their choice to have her continue to drive.

The litany of complaints about Olosky went back to 1997. She was fired in 2005 but later rehired.

"I still have nightmares all the time of that day. Nobody ever wants to ever experience it," Michael's father Jeff Dahlquist said.

Seattle Police believe that the bus driver was probably speeding when a vehicle in front of her suddenly put on the brakes. She swerved into the adjacent lane to avoid a rear-end collision, and struck Dahlquist's vehicle in the process.

In response to the fatal crash, Metro Transit has also agreed to start a program that re-trains public transportation drivers who have more than two accidents a year.

Dahlquist's mother, Sabrina, has also started a fight regarding a change in the law concerning emotional damages. As it stands, parents in Washington State cannot collect emotional damages for the loss of an adult child although they can sue for the loss of future wages.
