
A Seattle cyclist has won an $8 million personal injury lawsuit against the state of Washington this week – the largest payout in the country since 2003. The ruling came three years after 58-year-old Mark Gendler became paralyzed from a bike accident on Montlake Bridge.
In 2007, Gendler and a friend were riding on the bridge when his front bicycle tire became lodged in a groove. He flew over his handlebars and sustained a serious spinal cord injury that left him unable to walk, eat, work, or care for himself. Once a noted environmental attorney in Seattle, Gendler now struggles through each day and battles depression.
The gap in the bridge, which had been noted as dangerous by cyclists in the past, was filled by the Washington State Department of Transportation after the crash.
The $8 million settlement will help Gendler and his wife of 25 years Nan pay for the significant medical costs that come with a debilitating spinal cord injury. In addition, the money will make up for lost wages, as Gendler can no longer practice law as effectively as before. Already in the last three years, the couple has transformed their home to accommodate Gendler’s needs, which includes wheelchair access, automatic doors, and 13 hours of nursing care.
After all of it, Gendler said he would give back the money in a moment just to be healthy again – and to be able to ride his bike.
Washington State did not admit liability in the personal injury settlement.
