
Dog owners in Pierce County, Washington, won their dangerous dog appeal this week as the three-judge panel that heard their case not only reversed the previous dangerous dog order but also stated that the county’s dangerous dog ordinance was not constitutional.
The Washington dangerous dog case took place in April 2009 after a Great Pyrenees named Blizzard allegedly attacked a Pomeranian named Kayla, leaving the latter dog fatally injured. The owner of the smaller dog said that she saw a large dog run from her property with Kayla in its mouth, but did not see the attack or the cause of an attack. After four months, the owner claimed that Blizzard was the dog she saw. However, Blizzard’s owner Heidi Downey, said that her dog was kenneled at the time of the attack.
A hearing examiner concluded that Blizzard provoked the attack while loose and was therefore a dangerous dog. The Appellate court found that there was a concerning lack of evidence that Blizzard was involved in the dog attack and reversed the decision. In addition, the judges stated that it was unconstitutional for Pierce County to charge dog owners who wish to have their cases reviewed.
If Blizzard had been labeled a dangerous dog in Washington State, its owners would have had to buy the a dangerous dog tag and cage the animal – or else put it to sleep.
