A Washington family has filed a wrongful death lawsuit against a teen driver who struck and killed a cyclist in Kirkland this summer. The family is outraged that the driver was only asked to pay a $42 traffic ticket and believe that he may have been texting at the time of the deadly crash.
According to Seattle news sources, 49-year-old John Przychodzen was biking to a friend's house for dinner on Juanita Drive in Kirkland in July when he was struck twice by an 18-year-old Kenmore driver in a pickup truck. Przychodzen was on the shoulder of the road in a bike lane. Witnesses say the teenaged driver swerved into the bike lane several times before striking the cyclist. The bike rider was pronounced dead at the scene of the accident.
The teen driver was only fined $42 for an unsafe lane change, but witnesses to the accident claim that the pickup truck was swerving considerably and it appeared that the driver was distracted. The family of Przychodzen hopes that their Washington wrongful death lawsuit will either confirm or deny suspicions that the young man was texting or on his cell phone at the time of the collision. Police did not look at the driver's cell phone records during their own investigation.
The Andrew Kim law firm sends our condolences and thoughts to the family of John Przychodzen.
