The family of a man killed in a Chinatown crosswalk settled its wrongful death lawsuit against the City of Seattle for $2.75 million this week. According to the Northwest Asian weekly, this settlement comes three years after the fatal Washington pedestrian accident and two years after the family settled with the insurance company of the person who struck the man with his car.
Run Sen Liu was a 57-year-old immigrant from China who was in the restaurant business in Seattle for the nine years he lived in America. He was crossing the street in a marked crosswalk in February of 2007 when he was struck by a car going 35 miles per hour. The driver was cited for not carrying proof of insurance and for failing to yield to a pedestrian in a crosswalk.
Liu suffered a traumatic brain injury in the car accident and spent two years in the hospital suffering from his head injury before dying from complications in 2009. His mother and daughter say that his medical costs exceeded $1 million.
The Chinatown crosswalk had been known as a dangerous spot for years: five years before Liu was killed another person was struck and killed at the same spot, and a few months after Liu’s accident, the crosswalk was removed altogether. The wrongful death lawsuit stated that the City of Seattle was negligent in fixing a known problem with the roadway.
The fatal pedestrian case was scheduled to go to a Washington State jury this spring, but Seattle decided to settle before the trial began.
