
The parents of a 20-year-old Washington man who was shot two years ago have filed a Seattle wrongful death lawsuit against the a man who said he acted in self-defense. The claim seeks an unspecified amount for the pain and suffering of the young man’s parents.
In June 2010, Joseph Tobeck of Tenino was salvaging metal at the side of the road with a friend when they were confronted by 69-year-old William Morgan, who owned the home across the street. The friend asked if the pipes belonged to Morgan, who pointed a gun at them. The pair drove off, but hit a dead end and were forced to pass Morgan again. The man shot nine rounds into the pickup truck, striking Tobeck in the head and causing him to crash the truck into a tree. Witnesses say that Morgan initially prevented bystanders from giving medical assistance to Tobeck’s friend, who was seriously injured in the crash.
Morgan has stated that he feared for his life at the time of the shooting and acted in self-defense. However, the wrongful death lawsuit states that Morgan was negligent and reckless – adding that Morgan was shooting at the car after it had passed the property and acted aggressively toward the men without provocation.
