A personal injury lawsuit has been filed against coffee giant Starbucks after a San Antonio woman claimed that she received serious injuries from a tea spill caused by the company’s negligence.

According to the Washington injury lawsuit, which was filed in King County, Christina Sturgess went through a Starbucks drive-through in the summer of 2009 and ordered a venti green tea. When she took the first sip from her tea, the lid on the container fell off, spilling scalding hot liquid on the victim.

Her skin blistered immediately and she sought medical care. She was treated for second-degree burns and has undergone multiple surgeries and skin grafts since the accident as part of her recovery. She is seeking damages for pain and suffering, lost wages, and medical bills. The amount she is seeking is unspecified.

The personal injury claim states that the Starbucks barista did not correctly place the lid on the cup and that the lids had a defective design. Further, the lawsuit says that Starbucks was aware of the defective design and that the cups had caused other customers serious burn injuries and accidents in the past.

Starbucks has not responded to the lawsuit in court, though a representative stated that the coffee company takes the safety of its customers and workers seriously, and that the company brews its tea to industry standards.
