Hey there. Andrew Kim—your local personal injury and car accident attorney—here to talk to you about what should I do if I’m in a car wreck. Should I call the police, or shouldn’t I?
Well, I always recommend that you do call the police, just because that way everything is documented in the report so it doesn’t give the other driver a chance to change his story to his insurance company and make things more difficult than it ought to be.
I often see cases where the drivers decide they don’t want to call the police, for whatever reason, and the other driver says, “You know…I’m totally at fault, I accept full responsibility,” and sure enough once his insurance gets involved we find out that he’s changed his story and is now trying to put the blame on my client.
So, by calling the police, the police can write down the statements of both drivers shortly after the accident, which is going to be more reliable than a statement given a couple days, a few days, even a week after the accident to so-and-so’s insurance company.

Hey there. Andrew Kim—your local personal injury and car accident attorney—here to talk to you about, “How do I get my car repaired if I’ve been in a car wreck?”
Well, the first thing you should do is, if the other driver has insurance, is to file a claim with their insurance, and have one of their appraisers come out and look at your car either at your house or your workplace, or if it’s at a body shop, then at the body shop.
That appraiser will write up the initial amount of the estimate, and that estimate then will be the basis for the repairs at the body shop of your choice. And you do have a choice where you’d like to get your car repaired—the other insurance can’t force you to take it to one of their shops.
The initial estimate may be different from an estimate that you may have gotten beforehand from your body shop, but that shouldn’t be a problem because basically the body shop and the other insurance company will work out an agreed price to repair your car.
Now, while your car is in the shop, you’re entitled to a rental car. The other insurance will pay for your daily rental, and they won’t pay for any additional coverage. For example, if you don’t have collision coverage on your policy, or if you don’t have insurance at all, they won’t pay for that additional coverage—which is typically about ten dollars a day. But if you do have insurance and you have collision coverage than you won’t have to pay for that extra “collision damage waiver” is what it’s called through Enterprise Rent a-Car, for example.
So your car damage claim and your rental vehicle should all be taken care of by the other insurance.

If you’ve been in an accident, it’s really important to gather up all the evidence right after the accident.
You need to take photos of the car…photos of the scene…photos of your injuries…and that all has to be documented before it all goes away.
So, by hiring an attorney—by hiring Andrew Kim Law Firm—we’ll get that information for you to preserve your claim, and in the end, ultimately to reach a fair and reasonable settlement for your injuries.

Hey there. Andrew Kim—Bellevue car accident and injury attorney—here to talk to you about the recent 15-car pileup that was on I-90 the other day.
Apparently, a semi-truck driver had come to an abrupt stop or was attempting to come to an abrupt stop, and lost control of his truck when he sideswiped another semi, which was full of logs—thereby causing a chain reaction with 13 other passenger vehicles. Subsequent to the initial reports, it now appears that the first truck driver is trying to put the blame on the driver of the logging truck, saying that the logging truck actually sideswiped him, causing the chain reaction.
Now, what do you do if you were one of those unfortunate people involved in this collision? Well, my best advice is to go ahead open up a claim with your own insurance. If you were injured, go ahead an open up your PIP, personal injury protection, claim to pay for your medical bills, any time lost claim, things like that, and go ahead and open up your property damage claim through your collision coverage, which would take care of your car damage claim. The only downside there will be that you’ll be out your deductible, but the upside is that you’ll get your car repaired quicker than waiting for the two insurance companies of the semi trucks to figure it all out.
I would bet that in this sort of case where the two truck drivers are pointing fingers at each other, they’re never going to accept liability. There’s a high probability that you’re going to end up filing a lawsuit against both of those insurance companies. So, if you haven’t already, you might want to talk to an injury attorney and see what your rights are. These cases can be complicated and difficult because you're dealing with commercial policies and semi trucks.

According to the statistics, children under age 16 are the most likely to be struck by a car, but elderly victims are the most likely to die as a result of pedestrian or crosswalk accident injuries. Most pedestrian accidents occur on the weekends during the evening hours. Pedestrian accidents in the late afternoon increase when daylight savings time is removed in the winter and the sun sets earlier. If you or anybody you know was injured as a result of a pedestrain/motor vehicle crash please call an experianced Bellevue Seattle Pedestrain Accident Attorney Andrew Kim at the Andrew Kim Law Firm at 425-289-1990.
Hey there. Andrew Kim—your local personal injury and accident attorney—here to talk to you about BUI.
What is BUI? BUI stands for “boating under the influence.”
These days of the summer, when it’s nice and hot and warm, a lot of people go out on their boats or personal watercraft here on Lake Washington, or Lake Sammamish, maybe on Lake Chelan, or Moses Lake. Now, hand-in-hand with boating there is usually some alcohol or beer—which is fine—but, if the operator of that vessel, or boat, or para-watercraft has too much to drink that could put the passengers at risk, or could put other swimmers or other boaters at risk. Unfortunately, we see these cases where there is an accident and there are injuries involved.
A BUI is very similar to a DUI like in a car accident, but they are also different. These sort of cases need special attention and can be complicated. So, if you have any questions about that, if you were injured in a boating accident, please give us a call at (425) 289-1990 or you can contact our website at www.wainjurylaw.com
Hey there. Andrew Kim—your local personal injury and accident attorney here. The topic today is, “My child has been involved in an accident—what can I do?”
Well, as the parent or legal guardian of that child, you have the right to present the claim against the insurance company for the at-fault party where it involved a car accident, a semi-truck accident, or a dog bite case. Basically, you need to identify the insurance company and open up the claim on behalf of your child.
Now, whether you handle the claim yourself or have an attorney do it for you, once the case is settled it has to go through a court approval process. Any child under the age of 18 needs to go through this process only to protect the interest and settlement of the child.
The way it works is, a settlement guardian ad litem is appointed. A settlement guardian ad litem is an attorney experienced in personal injury cases, and that person will contact the parent and child and review through all the medical records and bills, and then write a report to the court either recommending the settlement amount, or not. There will be a hearing in front of the court, in court, in front of the judge. The judge will ultimately make the decision whether or not the settlement is reasonable.
If it is found to be reasonable, then the child’s portion of the money is put into a blocked account at a bank. Basically it’s there to protect the child and cannot be released until the child turns 18.
And, that’s basically it. If you have any other questions you can give us a call at (425) 289-1990 or contact our website at www.wainjurylaw.com
Did you know we represent kids for free?
Most attorneys charge between 33% and 40% of the
total recovery when a child's car accident is settled before a lawsuit is filed.
Andrew is a father of two young children and feels that kids are special and if a child's car accident case is settled without filing a lawsuit, then that child
should not be charged an attorney's fee.
Andrew is the first personal injury attorney in the State of Washington to offer a program that his friend and fellow Northen Virginia injury attorney Ben Glass developed.

Make it look like they’re on your side…That you’re in good hands.
Whatever their logo is, they want you to think that they’re on your side.
So, they’ll be the most friendliest person in the world. They’ll take care of your car damage claim, but when it comes down to the injury claim, they’re not going to make a reasonable offer. And, they’ll try to quickly sell the claim for less than what the case is worth.
Now, if you don’t have any injuries and you want to sell the case for 500 bucks, that’s fine, but most people don’t know the extent of their injuries until three days, a week, or even three weeks later and if you sign that release then it’s too late to do anything about it.
Insurance companies are out there to make a huge profit, and they do. They make billions of dollars every year, and the way they’re doing it is they’re paying out less on legitimate claims—in a car accident, for example. For every dollar they save, they’re making millions if you multiply that across the country by the number of claims that they handle.
The reason I know this is because I used to work on the other side as a claims adjuster, and we actually got specific training to minimize these claims…and the less you settled for, the more you got paid.
It’s definitely not to the benefit of the injured person, but to the benefit of the adjuster and the insurance company.
You are not in "Good Hands" or treated like a "Good Neighbor" if the same insurance company that you have been paying premiums for all these years, makes you jump through a bunch of hoops before they pay anything.

It provides legal remedies for policyholders, including the ability to seek punitive damages in court if their claims are unreasonably denied by their insurance companies or their insurance company violates particular regulations governing unfair claims settlement practices.
